BeWhere Limited Warranty (General Information)
Important Notice – Scope of This Warranty
This Limited Warranty is provided for general informational purposes only and applies unless otherwise expressly agreed in writing. Certain customers may be subject to additional, different, or superseding warranty terms under a separate written agreement with BeWhere, including but not limited to a master services agreement (MSA), purchase agreement, reseller agreement, or other contract.
In the event of any conflict, the terms of the applicable written agreement shall govern.
General Warranty Statement
This limited warranty gives the user specific legal rights, and the user may also have other rights, which vary from state to state.
BeWhere does not warrant or guarantee that any goods or services provided by BeWhere will be uninterrupted or error-free. BeWhere does not warrant or guarantee any results that may be obtained from the use of its goods or services.
During the applicable Warranty Period (defined below), BeWhere warrants that the goods purchased directly from BeWhere will be free from defects in materials and workmanship. All implied warranties, including without limitation the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the Warranty Period of this Limited Warranty, to the maximum extent permitted by law.
Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to all users.
Who May Use This Warranty
This limited warranty applies only to the original purchaser of the goods from BeWhere. It does not extend to any subsequent owner, transferee, or third party.
What This Warranty Covers
This limited warranty covers defects in materials and workmanship in BeWhere goods during the applicable Warranty Period.
What This Warranty Does Not Cover
This limited warranty does not cover damage, defects, or failures resulting from:

transportation or storage

improper use, handling, or installation
-
devices not properly installed and verified
-
failure to follow product instructions or perform preventive maintenance
-
modification or unauthorized repair
-
use with products, systems, materials, or processes not authorized in writing by BeWhere
-
normal wear and tear
-
accidents, abuse, or events beyond BeWhere’s reasonable control
This warranty does not cover service interruptions or failures caused by equipment incompatibility, telecommunications limitations, or other circumstances beyond BeWhere’s reasonable control. BeWhere shall have no liability for such interruptions or failures.
Batteries, misuse, abuse, and installation-related damage are expressly excluded from this warranty.
Warranty Period
This limited warranty begins on the date of shipment and applies for the following periods:

BeMini: 1 year from shipment

BeTen+: 1 year from shipment

BeWired+: 1 year from shipment
-
BeSol+: 1 year from shipment
Accessories such as sensors or mounting components may have different warranty periods. Customers should confirm applicable coverage with BeWhere or their authorized reseller prior to purchase.
Repair or replacement of goods under this warranty does not extend or renew the original Warranty Period.
Exclusive Remedy and Limitation of Liability
BeWhere’s sole obligation under this Limited Warranty is, at its option, to repair or replace the defective goods or refund the purchase price. This remedy is the user’s sole and exclusive remedy.
To the maximum extent permitted by law, BeWhere shall not be liable for any incidental, indirect, special, or consequential damages arising from any breach of this warranty.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to all users.
How to Obtain Warranty Service (RMA)
Warranty service is available only to authorized purchasers who bought goods directly from BeWhere.
Customers who purchased BeWhere goods through a reseller, distributor, integrator, or other third party must contact their original point of purchase to obtain warranty service and RMA authorization. BeWhere does not provide warranty support or RMAs directly to end users who did not purchase goods directly from BeWhere, unless otherwise expressly agreed in writing.

No warranty service will be provided, and no returns will be accepted, without an approved RMA issued by BeWhere.
Returned goods must be properly packaged and clearly labeled with the RMA number. Unless otherwise agreed, the authorized purchaser is responsible for all shipping and handling costs and bears the risk of loss during return shipment. If BeWhere determines that the goods are defective and covered under this Limited Warranty, BeWhere will reimburse reasonable return shipping costs.
If no defect is found, the goods will be returned as received, and shipping and handling costs may be charged.
